Mississippi DUI Penalties
First DUI conviction =- possible jail sentence of up to 48 hours;
- fine of at not less than $250 or more than $1,000;
- mandatory alcohol safety education; and
- driver’s license suspension for 90 days.
Second DUI conviction (within 5 years) =
- Mandatory jail sentence of at least 5 days and up to 12 months;
- Mandatory ignition interlock device installation for at least 6 months;
- fine of not less than $600 or more than $1,500; and
- driver’s license suspension for 2 years.
Third DUI conviction (within 5 years) =
- Mandatory jail sentence of at least 1 year and up to five years;
- Mandatory ignition interlock device installation for at least 6 months;
- vehicle seizure;
- fine of not less than $2,000 or more than $5,000; and
- driver’s license suspension for 5 years.
Breath Test Refusal Penalties
- 1st refusal = 90-day suspension of driver’s license
- Any additional refusal after 1st = 1-year suspension
